1. Definitions
For these Terms:
Artist means a User who submits, links or promotes music through Musin. An Artist may be a performer, producer, label, manager, distributor, publisher, rights holder or authorised representative.
Creator means a User who connects a social-media account and chooses to create and publish Creator Content using a Track.
Campaign means a time-limited opportunity through which an Artist makes a Track available for promotion by eligible Creators.
Campaign Instructions means optional information, creative suggestions, references, themes or preferences provided by an Artist in connection with a Campaign. Campaign Instructions do not remove the Creator’s creative freedom and are not conditions of payment unless they concern an expressly identified Technical Requirement.
Campaign Period means the period displayed on the Platform during which an eligible Post must be published.
Creator Content means a video, image, audio recording, caption, post, story, reel, short or other social-media content created or published by a Creator.
Fixed Payment means the payment displayed and accepted for one eligible Post. The Fixed Payment does not depend on views, likes, comments, shares, streams, sales, conversions or other performance metrics.
Platform means the Musin website, application, dashboard, marketplace, Campaign tools, payment tools and associated services.
Post means Creator Content published through an approved social-media account that includes the relevant Track as its soundtrack.
Promotion Agreement means the agreement formed through the Platform when an Artist and Creator accept a Campaign collaboration.
Technical Requirements means the objective requirements necessary for Post eligibility, consisting of:
- publication through the approved social-media account;
- publication during the Campaign Period;
- inclusion of the correct Track as the soundtrack of the Post;
- submission of a valid publication link through Musin; and
- any platform or format requirement clearly identified as mandatory before the Creator accepts the collaboration.
Track means a music recording, composition or other audio content submitted, uploaded or linked through Musin.
User means any person or organisation accessing or using the Platform.
5. How Campaigns work
An Artist may create a Campaign by providing information that includes:
- the Track;
- the Campaign Period;
- the permitted social-media platforms;
- the available Campaign budget;
- the Fixed Payment per Post;
- eligible Creator or account criteria;
- optional Campaign Instructions; and
- any clearly identified Technical Requirements.
A Creator may participate by:
- accepting a request from an Artist;
- applying or offering to participate in a Campaign; or
- selecting a Track from an open Campaign.
A Promotion Agreement is formed when the Artist and Creator accept the collaboration through the Platform.
The Promotion Agreement records:
- the relevant Track;
- the approved social-media account;
- the Campaign Period;
- the Fixed Payment;
- the permitted social-media platform; and
- any Technical Requirements.
Campaign Instructions are provided for guidance only. A Creator may consider and follow those instructions but retains full creative control over the Post.
An Artist may not introduce new mandatory content requirements after the Creator has accepted the collaboration.
6. Fixed payment model
The Creator becomes eligible for the Fixed Payment when:
- the Post is published through the approved social-media account;
- the Post is published during the Campaign Period;
- the correct Track is included as the soundtrack of the Post;
- the Post complies with the Technical Requirements;
- the Creator submits a valid publication link through Musin; and
- the Artist confirms the Post through the Platform.
The central service provided by the Creator is the inclusion of the correct Track as the soundtrack of independently created social-media content.
The Creator retains complete creative freedom over matters including:
- the concept;
- the visual content;
- the filming and editing style;
- the caption;
- the format;
- the setting;
- the presentation;
- the people appearing in the Post; and
- whether and how the Track or Artist is discussed.
Unless expressly identified as a Technical Requirement before acceptance, the Creator is not required to:
- mention the Artist or Track by name;
- provide a positive review or endorsement;
- use a specific script;
- include particular words, visuals or messages;
- follow a creative brief;
- submit the Post for creative approval;
- include a call to action;
- tag the Artist;
- add a particular caption or hashtag; or
- produce a particular level of engagement.
Failure to follow optional Campaign Instructions is not a valid reason to reject an otherwise eligible Post.
The Fixed Payment is not calculated according to views, likes, comments, shares, streams, followers, sales, conversions or other performance results.
An Artist may not reject an eligible Post because:
- the Artist does not like the Creator’s creative choices;
- the Post received fewer views or interactions than expected;
- the Creator did not provide a positive opinion about the Track;
- the Post differs from the Artist’s preferred creative style; or
- the Creator did not follow optional Campaign Instructions.
7. Artist obligations
By creating or funding a Campaign, the Artist confirms that:
- the Artist has authority to promote and license the Track;
- the Track does not infringe copyright, trademark, contractual or other third-party rights;
- the Artist has obtained all necessary permissions from performers, producers, songwriters, publishers, labels, distributors and other rights holders;
- the Artist has the right to authorise Creators to include the Track in social-media Posts;
- the Campaign information, Campaign Period and Fixed Payment are accurate;
- the Campaign is adequately funded;
- optional Campaign Instructions will not be presented as mandatory payment conditions;
- the Artist will respect the Creator’s creative independence;
- the Artist will review submitted Posts honestly and within the period displayed on the Platform;
- the Artist will confirm every Post that satisfies the Technical Requirements;
- the Artist will not reject a Post based on subjective dissatisfaction or performance results; and
- the Artist will not avoid Musin fees by moving an introduced collaboration outside the Platform.
The Artist may provide optional creative suggestions, references or preferences. The Creator is free to decide whether and how to use them.
The Artist may not require the Creator to express an opinion, recommendation or personal endorsement that the Creator does not genuinely wish to express.
8. Creator obligations and creative freedom
A Creator participating in a Campaign must:
- publish through the approved social-media account;
- publish during the Campaign Period;
- include the correct Track as the soundtrack of the Post;
- comply with the Technical Requirements accepted before publication;
- submit an accurate and accessible publication link through Musin;
- ensure that the Creator Content is original or otherwise lawfully used;
- comply with the applicable rules of the relevant social-media platform;
- not submit the same Post more than once for payment;
- not submit a Post created by another person without permission;
- not provide false or manipulated publication information; and
- keep the Post accessible at least until it has been reviewed and confirmed.
Subject to those requirements, the Creator has full creative freedom over the Creator Content.
Campaign Instructions are optional. A Creator may follow them in full, follow them partly or create an entirely independent concept.
The Creator is not required to obtain creative approval from the Artist before publication unless a separate pre-approval arrangement was expressly accepted by the Creator through the Platform.
The Creator remains responsible for ensuring that the Creator Content complies with applicable law and the rules of the relevant social-media platform.
Musin does not make the use of any particular advertising label, hashtag or disclosure a contractual condition for payment unless such a requirement is imposed by applicable law or the relevant social-media platform.
9. Confirmation of Posts
After publication, the Creator must submit the publication link through Musin.
The Artist must review the Post and either:
- confirm the Post; or
- raise a specific eligibility dispute.
The Artist may reject or dispute a Post only where there is a reasonable basis to believe that:
- the Post was published outside the Campaign Period;
- the Post was published through the wrong social-media account;
- the correct Track was not included as the soundtrack;
- the publication link is invalid or inaccessible;
- an expressly accepted Technical Requirement was not met;
- the same Post was submitted more than once;
- the Post was not genuinely published;
- the Creator does not control or lawfully manage the account;
- the Post was removed before confirmation; or
- the submission involves fraud or material misrepresentation.
The Artist may not reject a Post because:
- the Artist dislikes the creative concept;
- the content does not follow optional Campaign Instructions;
- the Artist expected different visuals, editing, wording or presentation;
- the Post does not contain praise or an endorsement;
- the Post received insufficient views, likes, comments, shares or streams; or
- the Campaign produced fewer results than the Artist expected.
Where the Artist does not confirm or dispute the Post within the review period displayed on the Platform, Musin may confirm the Post automatically or review the eligibility of the Post itself.
17. Confirmation and disputes
Where an Artist disputes a submitted Post, the Artist must identify the specific Technical Requirement that was allegedly not satisfied.
Musin may review:
- the publication link;
- the publication date and time;
- the social-media account;
- the soundtrack used;
- Campaign records;
- account information;
- screenshots;
- communications between the parties; and
- other relevant technical evidence.
Musin will not assess the artistic quality, attractiveness, popularity or subjective creative value of the Post.
Musin may decide to:
- confirm the Post and release the Fixed Payment;
- reject the Post because an objective eligibility requirement was not met;
- request additional evidence;
- permit the Creator to correct a technical submission error;
- cancel the Promotion Agreement;
- return the relevant Campaign funds;
- reverse a payment made because of fraud or an obvious technical error; or
- restrict an account for repeated abuse.
Low performance, subjective creative dissatisfaction or failure to follow optional Campaign Instructions are not valid grounds for withholding the Fixed Payment.
19. Refunds and payment reversals
An Artist is not entitled to a refund for an eligible and confirmed Post because:
- the Post performed below expectations;
- the Post received limited engagement;
- the Artist did not like the creative concept;
- the Creator did not follow optional Campaign Instructions;
- the Creator did not provide a positive endorsement;
- the Artist changed their marketing strategy; or
- the Campaign did not produce the expected number of streams, followers or listeners.
Musin may recover, reverse or deduct a Creator payment where:
- the wrong Track was used;
- the Post was published outside the Campaign Period;
- the Post was published through an unapproved account;
- the publication was fabricated;
- the same Post received duplicate payment;
- the Creator submitted false information;
- the Post was removed before confirmation;
- the payment resulted from an obvious technical error; or
- fraud occurred.

- violate applicable law or third-party rights;

A User acting for business or professional purposes will indemnify Musin against reasonable third-party claims, losses, damages and expenses resulting from:
- material breach of these Terms;
- infringement of intellectual-property rights;
- lack of rights in a Track or Creator Content;

Before a consumer purchases a paid Musin service, Musin will provide the required information concerning:
- the service;
- the total price;
- payment;
- performance;
- termination;
- complaint procedures; and
- any applicable right of withdrawal.
Where a consumer requests immediate performance of a digital service during a statutory withdrawal period, Musin may request express consent and acknowledgement of any effect on the right of withdrawal.
Most Artists, labels, agencies and Creators using Musin for commercial or professional activity may be treated as business users rather than consumers.

Please include your name, contact details, account information and a clear description of the complaint.

32. Privacy
Musin processes personal data as described in the Musin Privacy Policy.
The Privacy Policy forms part of the information provided to Users but does not replace these contractual Terms.
33. Changes to these Terms
Musin may update these Terms for legal, security, technical or commercial reasons.
Material changes will be communicated through the Platform, by email or by another appropriate method before they take effect.
Changes will generally apply prospectively. Continued use after the effective date constitutes acceptance where permitted by law.
If a User does not accept a material change, they may stop using the Platform and close their account, subject to outstanding obligations.
34. Transfer
A User may not transfer their account or rights under these Terms without Musin’s written permission.
Musin may transfer its rights and obligations as part of a merger, acquisition, corporate restructuring or sale of the Platform, provided that mandatory User rights are not reduced.
35. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain effective.
The invalid provision will be interpreted or replaced to reflect its intended lawful purpose as closely as possible.
36. No waiver
Failure to enforce a provision does not waive the right to enforce it later.
37. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Croatia and applicable European Union law.
For business Users, the courts competent for Musin’s registered office will have jurisdiction unless the parties agree otherwise.
Consumers may bring claims before any court available to them under mandatory consumer and jurisdiction law. A consumer’s mandatory protection under the law of their country of residence is not excluded.
38. Creator payments
Musin takes a 20% commission when creators withdraw funds from their account balance.
A post is considered completed only if all applicable campaign requirements are met:
- The post contains the correct track.
- The post is published within the campaign period.
- If the artist has set a required track timeframe, the post uses the correct section of the track.
The artist reviews the submitted post against these requirements. If the post does not meet them, the payment is not transferred to the creator’s Musin account balance.
